Intellectual Property and Privacy Protection

A senior employee leaves for a competitor taking a client list. Software developed in-house suddenly appears at a rival. Internal documents leak to the press. Private photographs circulate online. A well-known business figure's name is used to promote someone else's product. An article or post uses content you created without permission. In each of these, the first days determine whether the damage stays contained or spreads — and whether the position can be restored at all.

Ilan Bombach & Co. represents clients in complex intellectual property and privacy disputes, principally in litigation and urgent proceedings. The firm acts for rights-holders and companies seeking to protect intellectual property, confidential information and other business assets, as well as for defendants facing allegations of infringement. Its clients include businesspeople, chief executives, corporate officers, companies, public figures and private individuals in matters where a single document, publication or unauthorised use can have significant commercial or reputational consequences.

Three decades of litigation at the highest level

The firm is led by Ilan Bombach, one of Israel's leading litigators, with more than 30 years of experience and many hundreds of appearances before the Supreme Court. He has represented clients in some of Israel's most sensitive and complex civil, commercial and public proceedings, including cases involving privacy, publication, content, reputation and the use of information.

The firm's intellectual property and privacy practice draws on two core areas of experience. The first is civil and commercial litigation, where trade secrets, unfair competition and unauthorised use of content frequently arise. The second is privacy, publication and reputation, where such disputes often intersect with defamation law and media crisis management. This combination enables the firm to address both the commercial and public dimensions of these matters.

Personal involvement of the head of the firm

In this field, time is often decisive. Whether to seek an injunction immediately or wait, whether to send a measured demand or commence proceedings, and whether to act publicly or discreetly can determine whether the damage is contained or continues to spread.

Ilan Bombach personally leads the principal matters in this field, from the first consultation through warning letters, initial approaches and negotiations, to claims, applications for injunctions and court proceedings. In matters where timing and wording can materially affect the outcome, the personal involvement of a senior and experienced lawyer is particularly important.

Matters are handled discreetly. Many cases in this field require strict confidentiality, both in dealings between the parties and in managing any potential media exposure.

What we handle

  • Trade secrets, business information and misappropriation of client databases: representation of companies and individuals in disputes involving sensitive information, client lists or databases taken or allegedly taken when employees move between businesses, acting both for rights-holders and for employees accused of misappropriating information.
  • Unfair competition and harm to commercial reputation: disputes over imitation of products, misuse of another company's goodwill, interference with client relationships, and unlawful solicitation of employees.
  • Copyright and copying of content: representation in cases of unauthorised copying, publication, distribution or use of works, content and marketing materials, in print and digital media.
  • Restraint of trade and employees moving between employers: disputes over non-compete provisions, duties of loyalty and confidential information when senior employees move between companies. Our employment law page covers this dimension in more detail.
  • Invasion of privacy and publication of personal information: representation where personal information, photographs, recordings or sensitive details were published without consent, and of respondents accused of such conduct.
  • Use of name, image and reputation: disputes where a person's name, likeness or public identity has been exploited for advertising, promotion or to create a misleading impression.
  • Interim orders and urgent proceedings: applications for injunctions and takedown orders, rapid action to prevent the distribution of information or content, and immediate protection of assets and rights.
  • Defending claims in the field: representation of companies, individuals and senior figures facing claims, with emphasis on making full use of the statutory defences and limiting the damage.

Intersections with our other fields

Many matters in this field intersect with other areas handled by the firm. A trade-secrets case may also involve a shareholder dispute. An invasion of a public figure's privacy may also give rise to a defamation claim. Unauthorised use of a chief executive's name or image may also affect a company's reputation. Handling these issues under one roof enables the firm to maintain a single, coherent strategy across all aspects of the dispute.
